GENERAL TERMS OF SALE
Article 1 – OBJECT
The aim of these present general terms of sale is to define the rights
and obligations of the parties involved in the online sale of products
on the www.maillot-soraya.com
website by the company LOU'BEN GMBH & CO kG
Article 2 - PRICE
The prices of our products are indicated in euros, and are inclusive of
VAT and other taxes but exclude handling and carriage charges (packaging
and parcel processing according to fees currently in force).
All orders, no matter where they originate from, are payable in Euros.
Any change of the applicable VAT rate can be reflected in the prices
of the products. After this date, they can be modified at any time. The
prices however, can not be modified once the client’s order has
been processed. The prices indicated on the site are valid as long as
they appear on the website, subject to stock availability.
LOU'BEN GMBH & CO kG retains ownership of all products until they have been paid in
full.
Article 3 - ORDERS
All orders transmitted via the www.maillot-soraya.com
website imply the full and entire acceptance of the present general terms
of sale.
All orders assume acceptance of the prices and description of the products
available for sale. Any dispute in this regard will take place as part
of a possible exchange and under the guarantees set out below.
The user agrees to fill out the supplied form correctly, including, and
in a non-exclusive manner, the correct postal details.
Article 4 – AVAILABILITY
LOU'BEN GMBH & CO kG undertakes to make every effort to display the available products
on the website. If a product is no longer available, LOU'BEN GMBH & CO kG undertakes
to inform the user.
Article 5 – PAYMENT
Two methods of payment are available for the user:
Payment by credit card:
An email payment request by 'secure paypal' for the amount of your purchase
will be sent. As soon as your payment has been made, your order will be
fulfilled within the shortest period. Payment by cheque:
Send by post your payment by cheque and your order form (you can use either
a bank or postal cheque). Your order will be processed as soon as payment
has been received.
Article 6 – POSTAGE AND DELIVERY
Your order will be processed within an average delay of between 8 and
15 working days from receipt of your payment.
It will be sent via the “colissimo suivi” service (with a
signature required on delivery) or by carrier.
If the delay is exceeded, an order can be cancelled if it has not yet
been sent. In this situation, please contact us on: contact@maillot-soraya.com.
LOU'BEN GMBH & CO kG declines all responsibility concerning excessive delivery delays
caused by the postal service, means of transport, loss of ordered products
or strikes.
Article 7 - LIABILITY
LOU'BEN GMBH & CO kG does not accept liability in a situation where the failure to fulfil
the obligations is due either to an unpredictable and insurmountable problem
caused by a third party not involved in the contract or to a Force Majeur
as defined by the French Jurisprudence.
Likewise, LOU'BEN GMBH & CO kG may not be held liable for any inconvenience or damage
caused by the use of the Internet network, particularly a breakdown in
the service, an external intrusion or the presence of computer viruses.
Article 8 – RETURNS AND WITHDRAWAL POLICY
In accordance with the article L.121-20 and those following it in the
Consumer’s Regulations, you have a delay of 7 working days taking
effect from the delivery day of your order, to return any product that
does not suit you, in its original packaging and in good condition, specific
to its resale and to request an exchange or a reimbursement without penalty,
excluding the return carriage fees. You therefore have 7 days to inform
us that you wish to withdraw from the purchase.
Article 9 - APPLICABLE LAW AND JURISDICTION
The present conditions are in accordance with French law. The competent
court in case of a dispute will be in the vicinity of the defendant’s
domicile or, by the plaintiff’s choice, in the location where the
product was delivered.
